The featured case discussion on the role of consent and individual autonomy in the PIP breast implant scandal raises interesting and important questions regarding the right of patients (and individuals in general) to decide whether to have their personal data included in medical registries and used for research. The fate of the National Breast Implant Registry, following the introduction of a policy that demanded formally recorded informed consent, is particularly enlightening. Combined with the (ex post) fact that reliable and comprehensive (...) data would have been useful in this specific case, it clearly illustrates the dangers of overemphasizing individual autonomy in observational research. The issue is timely, as the European Commission has recently proposed a new Data Protection Regulation (European Commission, 2012) that may have serious implications for registry based research. In this commentary, I will first discuss two aspects of the regulatory framework that arguably contribute to the problematic situation and then offer an alternative view on why requiring consent should not be the default position in this kind of research. Our starting point in this article is the debate between John Harris and Iain Brassington on whether or not there is a duty to take part in scientific research. We consider the arguments that have been put forward based on fairness and a duty to rescue, and suggest an alternative justification grounded in a hypothetical agreement: that is, because effective healthcare cannot be taken for granted, but requires continuous medical research, and nobody knows what kind of healthcare they will need, (...) participating in research should be viewed from the perspective of a social contract, based on our mutual need for medical advances. In this commentary on ‘Why participating in scientific research is a moral duty’, I take issue with a number of Stjernschantz Forsberg et al's claims. Though abiding by the terms of a contract might be obligatory, this won't show that those terms themselves indicate a duty—even allowing that there's a contract to begin with. Meanwhile, though we might have reasons to participate, not all reasons are moral reasons, and the paper does not establish that the reasons here are (...) moral in character. (shrink)

We argue that there are neither scientific nor social reasons to require gathering ethno-racial data, as defined in the US legal regulations if researchers have no prior hypotheses as to how to connect this type of categorisation of human participants of clinical trials with any mechanisms that could explain alleged interracial health differences and guide treatment choice. Although we agree with the normative perspective embedded in the calls for the fair selection of participants for biomedical research, we demonstrate that current (...) attempts to provide and elucidate the criteria for the fair selection of participants, in particular, taking into account ethno-racial categories, overlook important epistemic and normative challenges to implement the results of such race-sorting requirements. We discuss existing arguments for and against gathering ethno-racial statistics for biomedical research and present a new one that refers to the assumption that prediction is epistemically superior to accommodation. We also underline the importance of closer interaction between research ethics and the methodology of biomedicine in the case of population stratifications for medical research, which requires weighing non-epistemic values with methodological constraints. May assumes that if moral beliefs are counterfactually dependent on irrelevant factors, then those moral beliefs are based on defective belief-forming processes. This assumption is false. Whether influence by irrelevant factors is debunking depends on the mechanisms through which this influence occurs. This raises the empirical bar for debunkers and helps May avoid an objection to his Debunker’s Dilemma.

Numerous authors indicate that the influence of academic education extends beyond the growth of specialized knowledge gained by the graduates. Scholars are trying to identify and examine the potential impact of higher learning on students’ attitudes and choices. One of the dimensions considered by the researchers is the effect of university training on students’ moral choices. Our paper attempts to identify differences between the students’ declared moral choices and their majors (fields of studies). Working with a sample of university students (...) of Economics and Sociology (N = 181), and using three variants of the Trolley Problem, the subjects’ responses are used to identify the similarities and differences between their choices. The participants were asked to respond to three hypothetical situations regarding a runaway trolley. Their decision in the first scenario could save a person’s life or let her be run over by the trolley. In the second scenario, their decision could either let one person die and save five lives or save one life and let five people be killed. These two scenarios required pulling a lever to switch the trolley from one track to another. The third scenario requires pushing an obese person in front of the runaway trolley to stop it from killing five persons. As expected, we found a significant difference between the two groups (the economists and the sociologists) in the case of our third scenario, however, we found no evidence supporting the indoctrination hypothesis. We conclude that the existing differences between the choices made by the future economists and sociologists may support the preselection hypothesis. (shrink)

The concept of biodiversity has played a central role within conservation biology over the last thirty years. Precisely how it should be understood, however, is a matter of ongoing debate. In this paper we defend what we call a classic multidimensional conception of biodiversity. We begin by introducing two arguments for eliminating the concept of biodiversity from conservation biology, both of which have been put forward in a recent paper by Santana. The first argument is against the concept’s scientific usefulness. (...) The other is against its value as a target of conservation. We show that neither of these objections is successful against the classic multidimensional conception of biodiversity. Biodiversity thus understood is important from a scientific perspective, because it plays important explanatory roles within contemporary ecology. Moreover, although it does not encompass all valuable features of the natural world, this does not show that we should abandon it as a target of conservation. Instead, biodiversity should be conceived as one of many grounds of value associated with ecosystems. This is consistent with concluding that a central aim of conservationists should be to protect biodiversity. (shrink)

Globally, there are calls to increase physical activity levels in relatively sedentary populations, including via physical activity programmes, often targeted at those body-selves deemed at risk of ‘sedentariness’. Despite the salience of sensory pleasures and displeasures in engagement with (and abandonment of) these programmes, the sensory, embodied experiences of participation remain under-researched. Here, we draw on findings from a two-year ethnographic study of a national programme in Wales, which used the aesthetic attractions of ‘natural’ outdoor environments to encourage and sustain (...) physical activity. Employing insights from phenomenological sociology, we explore the programme participants’ (n=146) lived experiences, analysed via a phenomenological lens, cohering around a panoply of sensory pleasures and displeasures, and somatic learning that is shaped and reshaped by weather encounters. This article concerns the implementation of new EU Directives coordinating the procedures for awarding public contracts in European Union Member States. In a number of countries, including Poland, the process of their implementation (Directive 2014/24/eu of the European Parliament and of the Council of 26 February 2014 on public procurement; Directive 2014/25/eu of the European Parliament and of the Council of 26 February 2014 on procurement by entities operating in the water, energy, transport, and postal services sectors; Directive 2014/23/eu of (...) the European Parliament and of the Council of 26 February 2014 on the award of concession contracts) was delayed. In most cases, the modernization of EU regulations on public procurement required a thorough modification of national regulations in this respect. As a result of the introduction of the package of new Directives, the European Union public procurement market has undergone substantial changes. The need to adjust legal regulations to the changing political, social, and economic situations in a better way has resulted in the transposition of the modernized EU Directives concerning public procurement to the Polish legal system, affecting the final shape of the new Polish Public Procurement Law. The implementation of the package of new Directives has significantly affected the functioning of the Polish public procurement market. For the entities operating in this market, this means the necessity to expand their knowledge, so as to become familiar with the new legal solutions in this respect. (shrink)

This paper introduces Basic Intuitionistic Set Theory BIST, and investigates it as a first-order set theory extending the internal logic of elementary toposes. Given an elementary topos, together with the extra structure of a directed structural system of inclusions on the topos, a forcing-style interpretation of the language of first-order set theory in the topos is given, which conservatively extends the internal logic of the topos. This forcing interpretation applies to an arbitrary elementary topos, since any such is equivalent to (...) one carrying a dssi. We prove that the set theory BIST+Coll is sound and complete relative to forcing interpretations in toposes with natural numbers object. Furthermore, in the case that the structural system of inclusions is superdirected, the full Separation schema is modelled. We show that all cocomplete and realizability toposes can be endowed with such superdirected systems of inclusions.A large part of the paper is devoted to an alternative notion of category-theoretic model for BIST, which, following the general approach of Joyal and Moerdijkʼs Algebraic Set Theory, axiomatizes the structure possessed by categories of classes compatible with BIST. We prove soundness and completeness results for BIST relative to the class-category semantics. Furthermore, BIST+Coll is complete relative to the restricted collection of categories of classes given by categories of ideals over elementary toposes with nno and dssi. It is via this result that the completeness of the original forcing interpretation is obtained, since the internal logic of categories of ideals coincides with the forcing interpretation. (shrink)

One of the most widely applied techniques used to examine associative memory errors is the Deese-Roediger- McDermott paradigm. The aim of the present studies was to demonstrate a Polish version of the DRM paradigm and to test the characteristics of memory illusions evoked by this procedure for both recall and recognition. A normative study was conducted to prepare Polish stimuli material sharing similar characteristics as the lists in the English language version. Subsequently, the lists were applied to examine the effect (...) of prior recall on recognition, as well as the influence of retention interval on recall. The results revealed that the Polish version of the DRM paradigm induced a robust effect of false recall and recognition. Moreover, it was revealed that immediate recall of a single list led to a higher rate of both correct and false recall and that prior recall positively influenced recognition, leading to a higher rate of hits. DESCARTES’S PASSIONS OF THE SOUL AND THE CONTEMPORARY DISPUTE ABOUT THE NATURE OF EMOTION In my article I discuss the connection between the Cartesian theory of passions of the soul and the contemporary dispute between the cognitive and non-cognitive theories of emotions. Defenders of the cognitive theory of emotions identify emotions with judgments. On the other hand, non-cognitivists claim that emotions are feelings caused by changes in physiological conditions relating to the autonomic and motor functions. Both cognitivists’ and non-cognitivists’ approaches (...) meet serious problems. In the paper, I want to show that the Cartesian theory of passions can be considered an anticipation of contemporary views and a compromise between the cognitive and non-cognitive theories of emotions. A growing body of research is exploring corporate communication in relation to corporate social responsibility (CSR) activities on social media (SM). Nonetheless, while these studies have shown that SM communication may be an effective tool for reaching and engaging various stakeholders, how the design of corporate CSR communication engenders trustworthiness has yet to be examined. To address this gap, we suggest that SM communication may include important signals related to trust; thus, we investigate whether companies use sources of trustworthiness (reputation, (...) performance, and appearance) while communicating with stakeholders and the response of the latter to such communication. Our empirical analysis is based on a database containing over 66,000 CSR-related messages from eight companies focusing on communication extracted from Twitter. These data are coded according to three sources of trustworthiness and two dimensions of CSR communication (social and environmental). Our findings indicate that all three attributes of trustworthiness are used by companies in their CSR social media communication. We also document how corporate efforts to use CSR communication that engenders trustworthiness influence stakeholder engagement. Our study therefore contributes to the literature on trust in relation to CSR by illustrating the importance of signaling that includes different sources of trustworthiness or their combination in corporate communication. By analyzing how the various trust attributes included in CSR communication affect SM reactions, we also identify which attributes lead to greater stakeholder engagement overall, particularly for the two analyzed dimensions of CSR communication. In addition to the traditional personnel and human resource management (HRM), there is a need for a new approach to personnel management, which we will call Human Capital Management (HCM). HCM emphasises an alignment between the individual and the organization and in our view offers the challenge and the key to successful management in the future.

The main purpose of this article is a presentation of the H. Elzenberg's philosophical theory of the ethical ideal. I pay special attention to the most interesting, from the ethical point of view, parts of his concept. Elzen-berg proposed the ethical ideal, the so called ‘homo ethicus’. I present two ways of its realisation: melioristic and soteristic. My aim is also to prove that Elzenberg’s theory demonstrates that some features of ethical activity distinguish a human being from the background of (...) the natural world and make them exceptional. These attributes include: the realisation of the perfect values such as the good and the beauty, having an ethical will, self-sacrifice, aspiring to perfection and moral salvation. (shrink)

The first goal of this study was to validate the Rational-Experiential Inventory (REI) and the Cognitive Reflection Test (CRT) through checking their relation to the transitivity axiom. The second goal was to test the relation between decision strategies and cognitive style as well as the relation between decision strategies and the transitivity of preferences. The following characteristics of strategies were investigated: requirements for trade-offs, maximization vs. satisficing and option-wise vs. attribute-wise information processing. Respondents were given choices between two multi-attribute options. (...) The options were designed so that the choice indicated which strategy was applied. Both the REI-R and the CRT were found to be good predictors of the transitivity of preferences. Respondents who applied compensatory strategies and the maximization criterion scored highly on the REI-R and in the CRT, whereas those who applied the satisficing rule scored highly on the REI-R but not in the CRT. Attribute-wise information processing was related to low scores in both measurements. Option-wise information processing led to a high transitivity of preferences. (shrink)

Automated translation is systematically gaining popularity among professional translators, who claim that editing MT output requires less time and effort than translating from scratch. MT technology is also offered in leading translator’s workstations, e.g., SDL Trados Studio, memoQ, Déjà Vu and Wordfast. Therefore, the dilemma arises: should MT be introduced into formal translation training? In order to answer this question, first, it is necessary to understand how trainee translators actually use MT. This study is an attempt to obtain this knowledge. (...) The methodology applied in this investigation is text analysis. During the experiment sessions the students were asked to translate a legal text using MT tools, which in practice meant the post-editing of the MT raw output. The post-edited versions of the text underwent analysis in order to answer the following research questions: - What are the most typical errors contained in both French and English MT output? - How critical are the students towards the text generated by MT? - How perceptive are the students during the post-editing task? - Are they able to detect and correct errors using their knowledge and skills? The results of this study suggest that the post-editing of the MT raw output is as demanding for translation students as traditional translation, however, it requires a different set of skills, such as critical thinking and perceptiveness. Therefore, a special kind of training related to the effective use of MT technology should be implemented during translation classes. (shrink)

Archive Materials of Mieczysław Wallis are in the collection of Combined Libraries of Philosophy and Sociology Faculties of the University of Warsaw, the Institute of Philosophy and Sociology of the Polish Academy of Science and the Polish Philosophical Society. There are two files devoted to Henryk Elzenberg. They contain a rich historical material, not published before and not known to many people. It is a valuable source of knowledge in the field of the history of Polish philosophy. Wallis’s notes provide (...) a lot of unique informations both on Elzenberg’s private life and also his activity in the scientific community. Furthermore, they present his philosophical concepts, as well as his motions of life and adversities he had to cope with. M. Wallis’s memoirs are an unusual record of the friendship and scientific co-operation of the two scholars that lasted for a few decades. Wallis’s work creates also an intellectual testimony of the epoch, in which they both lived and worked. (shrink)

Language Lost and Found takes as its starting-point Iris Murdoch's claim that "we have suffered a general loss of concepts." By means of a thorough reading of Iris Murdoch's philosophy in the light of this difficulty, it offers a detailed examination of the problem of linguistic community and the roots of the thought that some philosophical problems arise due to our having lost the sense of our own language. But it is also a call for a radical reconsideration of how (...) philosophy and literature relate to each other on a general level and in Murdoch's authorship in particular. (shrink)

Liberal societies are characterized by respect for a fundamental value pluralism; i.e., respect for individuals’ rights to live by their own conception of the good. Still, the state must make decisions that privilege some values at the cost of others. When public ethics committees give substantial ethical advice on policy related issues, it is therefore important that this advice is well justified. The use of explicit tools for ethical assessment can contribute to justifying advice. In this article, I will discuss (...) one approach to ethical assessment, the ethical matrix method. This method is a variant of intuitionist balancing. Intuitionism is characterized by stressing the existence of several (at least two) fundamental prima facie moral principles, between which there is no given rank order. For some intuitionist approaches, coherentism has been proposed as a model of justification. This article will discuss justification of ethical advice and evaluate the appropriateness of coherentism as a justificatory approach to intuitionist tools. (shrink)

It is often said that the institutions of criminal justice ought or—perhaps more often—ought not to rehabilitate criminal offenders. But the term ‘criminal rehabilitation’ is often used without being explicitly defined, and in ways that are consistent with widely divergent conceptions. In this paper, we present a taxonomy that distinguishes, and explains the relationships between, different conceptions of criminal rehabilitation. Our taxonomy distinguishes conceptions of criminal rehabilitation on the basis of the aims or ends of the putatively rehabilitative measure, and (...) the means that may be used to achieve the intended end. We also explore some of the implications of each conception, some of the payoffs of a taxonomy of the kind we offer, and some areas for future work. (shrink)

Life typically becomes an object of reflection when it is seen to be under threat. In particular, humans have a tendency to engage in thinking about life (instead of just continuing to live it) when being confronted with the prospect of death: be it the death of individuals due to illness, accident or old age; the death of whole ethnic or national groups in wars and other forms of armed conflict; but also of whole populations, be they human or nonhuman. (...) Even though Minimal Ethics for the Anthropocene is first and foremost concerned with life--understood as both a biological and social phenomenon--it is the narrative about the impending death of the human population (i.e., about the extinction of the human species), that provides a context for its argument. "Anthropocene" names a geo-historical period in which humans are said to have become the biggest threat to life on earth. However, rather than as a scientific descriptor, the term serves here primarily as an ethical injunction to think critically about human and nonhuman agency in the universe. Restrained in tone yet ambitious in scope, the book takes some steps towards outlining a minimal ethics thought on a universal scale. The task of such minimal ethics is to consider how humans can assume responsibility for various occurrences in the universe, across different scales, and how they can respond to the tangled mesh of connections and relations unfolding in it. Its goal is not so much to tell us how to live but rather to allow us to rethink "life" and what we can do with it, in whatever time we have left. Over the last years, Norway has revised its animal welfare legislation. As of January 1, 2010, the Animal Protection Act of 1974 was replaced by a new Animal Welfare Act. This paper describes the developments in the normative structures from the old to the new act, as well as the main traits of the corresponding implementation and governance system. In the Animal Protection Act, the basic animal ethics principles were to avoid suffering, treat animals well, and consider their natural needs (...) and instincts. In addition, a principle for balancing our duties towards animals with the needs and interests of humans was expressed by the formulation unnecessary suffering. These principles (only with slightly different formulations) are retained in the new act. The novelty of the new act is shown by its explicit intention to promote respect for animals and its recognition of animals’ intrinsic value. Whereas intrinsic value is only given a symbolic function, the notion of respect is intended to have practical consequences. One interpretation of respect for animals is taking the animal’s integrity—and not only welfare—into account. Another is to see the introduction of respect as a call to animal keepers to provide animals with welfare exceeding the minimum requirements. In several respects, the legal system now seems to leave more responsibility to the individual animal keeper—and to citizens in general. I argue that if the authorities really do want to promote respect for animals, they must at the same time initiate activities to achieve this. In my perspective the challenge is to provide adequate measures to achieve in practice the intended respect for animals expressed in the new act. (shrink)

Unprecedented advances in medicine, genetic engineering, and demographic forecasting raise new questions that strain the categories and assumptions of traditional ethical theories. Heyd's approach resolves many paradoxes in intergenerational justice, while offering a major test case for the profound problems of the limits of ethics and the nature of value.

Focusing on the penultimate chapter of Collingwood's An Essay on Philosophical Method, this paper offers a re-evaluation of several points in leading interpretations of his philosophy. It is argued that this chapter, 'Philosophy as a Branch of Literature', invites us to rethink the relation between a systematic or problem-oriented and an historical or exegetical philosophy; how linguistic analysis (particularly in the form of ordinary language philosophy) relates to the history of philosophy; and how the question of literature in philosophy is (...) not merely a question about literature, but of philosophy. In contrast to influential interpreters such as e.g. Connelly and D'Oro, it is here argued that Collingwood (a) offers a profound criticism of the idea that philosophical problems are eternal, (b) invites us to deepen our understanding of ordinary language philosophy aswell as (c) the idea of a therapeutic method in philosophy, and (d) problematizes the tendency to think that the question about the form philosophical writing takes is a secondary issue that can be side-stepped. Background Despite the bourgeoning of digital tools for bioethics research, education, and engagement, little research has empirically investigated the impact of interactive visualizations as a way to translate ethical frameworks and guidelines. To date, most frameworks take the format of text-only documents that outline and offer ethical guidance on specific contexts. This study’s goal was to determine whether an interactive-visual format supports frameworks in transferring ethical knowledge by improving learning, deliberation, and user experience.Methods An experimental comparative study was conducted with (...) a pre-, mid-, and post-test design using the online survey platform Qualtrics. Participants were university based early-stage health researchers who were randomly assigned to either the control condition (text-only document) or the experimental condition (interactive-visual). The primary outcome variables were learning, (measured using a questionnaire), deliberation (using cases studies) and user experience (measured using the SED/UD Scale). Analysis was conducted using descriptive statistics and mixed-effects linear regression.Results Of the 80 participants, 44 (55%) used the text-only document and 36 (45%) used the interactive-visual. Results of the knowledge-test scores showed a statistically significant difference between participants’ post-test scores, indicating that the interactive-visual format better supported understanding, acquisition, and application of the framework’s knowledge. Findings from the case studies showed both formats supported ethical deliberation. Results further indicated the interactive-visual provided an overall better episodic and remembered user experience compared with the text-only document.Conclusions Our findings show that ethical frameworks formatted with interactive and visual qualities provide a more pleasing user experience and are effective formats for ethics learning and deliberation. These findings have implications for practitioners developing and deploying ethical frameworks and guidelines (e.g., in educational or employee-onboarding settings), in that the knowledge generated can lead to more effective dissemination practices of normative guidelines and health data ethics concepts. The question of whether AI systems such as robots can or should be afforded moral agency or patiency is not one amenable either to discovery or simple reasoning, because we as societies constantly reconstruct our artefacts, including our ethical systems. Consequently, the place of AI systems in society is a matter of normative, not descriptive ethics. Here I start from a functionalist assumption, that ethics is the set of behaviour that maintains a society. This assumption allows me to exploit the (...) theoretical biology of sociality and autonomy to explain our moral intuitions. From this grounding I extend to consider possible ethics for maintaining either human- or of artefact-centred societies. I conclude that while constructing AI systems as either moral agents or patients is possible, neither is desirable. In particular, I argue that we are unlikely to construct a coherent ethics in which it it is ethical to afford AI moral subjectivity. We are therefore obliged not to build AI we are obliged to. Everyone knows what is feels like to be in pain. Scraped knees, toothaches, migraines, giving birth, cancer, heart attacks, and heartaches: pain permeates our entire lives. We also witness other people - loved ones - suffering, and we 'feel with' them. It is easy to assume this is the end of the story: 'pain-is-pain-is-pain', and that is all there is to say. But it is not. In fact, the way in which people respond to what they describe as 'painful' has (...) changed considerably over time. In the eighteenth and nineteenth centuries, for example, people believed that pain served a specific (and positive) function - it was a message from God or Nature; it would perfect the spirit. 'Suffer in this life and you wouldn't suffer in the next one'. Submission to pain was required. Nothing could be more removed from twentieth and twenty-first century understandings, where pain is regarded as an unremitting evil to be 'fought'. Focusing on the English-speaking world, this book tells the story of pain since the eighteenth century, addressing fundamental questions about the experience and nature of suffering over the last three centuries. How have those in pain interpreted their suffering - and how have these interpretations changed over time? How have people learnt to conduct themselves when suffering? We engage with the nature and the value of achievement through a critical examination of an argument according to which biomedical “enhancement” of our capacities is impermissible because enhancing ourselves in this way would threaten our achievements. We call this the argument against enhancement from achievement. We assess three versions of it, each admitting to a strong or a weak reading. We argue that strong readings fail, and that weak readings, while in some cases successful in showing that enhancement interferes (...) with the nature or value of achievement, fail to establish that enhancement poses an unusual threat to achievement.
